hereinafter referred to as the provider.
subject matter of the contract
This contract regulates the sale of
new goods
from the field(s) of mechanical engineering
via the provider’s online shop. For details of the respective offer, please refer to the product description on the offer page.
contract conclusion
The contract is concluded in electronic commerce via the shop system or via other means of distance communication such as telephone and email. The offers presented represent a non-binding invitation to submit an offer through the customer’s order, which the provider can then accept.
The ordering process for concluding a contract in the shop system comprises the following steps:
- Selection of the offer in the desired specification (size, color, quantity)
- Adding the offer to the shopping cart
- Proceed to checkout
- Entering the billing and delivery address
- Selecting the payment method
- Review and processing of the order and all entries
- Pressing the ‘Buy now’ button
- Confirmation email that the order has been received
In addition to the shop system, orders can also be placed via remote communication (telephone/email), whereby the ordering process for concluding a contract comprises the following steps:
- Call the order hotline / Send the order email
- Confirmation email that the order has been received
The contract is concluded upon dispatch of the order confirmation.

The contract is concluded for an indefinite period.
retention of title
The delivered goods remain the property of the supplier until full payment has been made.
Prices, shipping costs, return shipping costs
All prices are final prices and include statutory sales tax.
In addition to the final prices, additional costs may apply depending on the shipping method, which will be displayed before the order is shipped.
If there is a right of withdrawal and this is exercised, the customer shall bear the costs of the return shipment.

The customer has only the following payment options:
advance transfer
Other payment methods are not offered and will be rejected.
Payment is due without deduction from the invoice date.
terms of delivery
The goods will be shipped immediately after receipt of payment has been confirmed.
Shipment takes place on average within 3 days at the latest.
The entrepreneur undertakes to deliver on the 7th day after
confirmed receipt of payment.
The standard delivery time is 3 days, unless otherwise stated in the item description.
The supplier will ship the order from its own warehouse as soon as the entire order is in stock there.
warranty
Consumers are entitled to a statutory warranty for defects in accordance with the relevant provisions of the German Civil Code (BGB). In the event of any deviation from this, the warranty shall be governed by the provisions set out in the General Terms and Conditions (GTC).
If the customer is an entrepreneur, the warranty is excluded for used goods.
If the customer is a consumer, the warranty period for used goods is limited to one year.
This does not apply to claims for damages by the customer due to injury to life, limb, health, or essential contractual obligations that must be fulfilled in order to achieve the contractual objective. Likewise, this does not apply to claims for damages resulting from grossly negligent or intentional breach of duty by the provider or its legal representative or vicarious agent. In all other respects, the statutory provisions apply.
Right of withdrawal and customer service

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day
- In the case of a purchase contract: on the day on which you or a third party designated by you, who is not the carrier, took possession of the last goods.
- In the case of a contract for multiple goods that the consumer has ordered as part of a single order and that are delivered separately: on the day on which you or a third party designated by you, who is not the carrier, took possession of the last goods.
- In the case of a contract for the delivery of goods in multiple partial shipments or pieces: when you or a third party designated by you, who is not the carrier, has taken possession of the last partial shipment or the last piece.
- In the case of a contract for the regular delivery of goods over a specified period of time: when you or a third party designated by you, who is not the carrier, took possession of the first goods.
If there are several alternatives, the latest date is decisive.
To exercise your right of withdrawal, you must inform us (Forstreich Maschinenbau Einzelunternehmen, Stefan Reichenbach, Im Gewerbepark 17, 79252 Stegen, Germany) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You may use the attached sample withdrawal form for this purpose, but this is not mandatory.
To comply with the withdrawal period, it is sufficient that you send the notification of your exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of revocation
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the inexpensive standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to Forstreich Maschinenbau Einzelunternehmen, Stefan Reichenbach, Im Gewerbepark 17, 79252 Stegen, Germany, without delay and in any case no later than fourteen days from the date on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.
You shall bear the direct costs of returning the goods.
You shall only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for testing their condition, properties, and functionality.
End of the cancellation policy
Disclaimer
Claims for damages by the customer are excluded, unless otherwise specified in the following reasons. This also applies to the provider’s representatives and vicarious agents if the customer asserts claims for damages against them. Excluded from this are claims for damages by the customer due to injury to life, limb, health, or essential contractual obligations that must be fulfilled in order to achieve the contractual objective. Likewise, this does not apply to claims for damages resulting from grossly negligent or intentional breach of duty by the provider or its legal representative or vicarious agents.
Prohibition on assignment and pledging
Claims or rights of the customer against the provider may not be assigned or pledged without the provider’s consent, unless the customer has demonstrated a legitimate interest in the assignment or pledge.
Language, place of jurisdiction, and applicable law
The contract is written in German. The further implementation of the contractual relationship shall be in German.
The law of the Federal Republic of Germany shall apply exclusively. For consumers, this shall only apply insofar as it does not restrict any statutory provisions of the state in which the customer has their domicile or habitual residence.
Severability clause
The invalidity of any provision of these General Terms and Conditions shall not affect the validity of the remaining provisions.
